The Importance of Accident Investigations

Accident investigations allow employers to understand exactly how and why an incident occurred. Why Accident Investigations Are Legally Required 

Under the Health and Safety at Work etc. Act 1974, employers have a duty to ensure, so far as is reasonably practicable, the health, safety and welfare of employees and others affected by their work. Investigating accidents is a key part of fulfilling this duty because it helps employers understand whether their risk controls were adequate and functioning as intended. 

The Management of Health and Safety at Work Regulations 1999 also require employers to assess risks and implement effective control measures. When an accident occurs, it is evidence that something within the risk management system has failed. A thorough investigation is therefore necessary to review and improve those controls. 

Failing to investigate incidents can lead to enforcement action, increased insurance costs, reputational damage, and further preventable harm. 

What RIDDOR Is and When It Applies 

The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR) require employers, responsible persons and those in control of work premises to report certain serious workplace incidents to the Health and Safety Executive or local authority.  

RIDDOR covers: 

  • Work-related fatalities 
  • Specified injuries to workers 
  • Injuries resulting in more than seven days of incapacity 
  • Certain occupational diseases 
  • Dangerous occurrences with the potential to cause harm 

The purpose of RIDDOR is to ensure that enforcing authorities are informed when serious incidents occur so they can monitor trends, investigate where necessary, and ensure compliance with health and safety law.
