{"id":9250,"date":"2019-08-22T16:15:47","date_gmt":"2019-08-22T16:15:47","guid":{"rendered":"https:\/\/mbosafetyservices.co.uk\/staging\/?p=9250"},"modified":"2019-08-22T16:15:47","modified_gmt":"2019-08-22T16:15:47","slug":"company-and-director-fined-following-dangerous-construction-work-around-a-domestic-boiler","status":"publish","type":"post","link":"https:\/\/mbosafetyservices.co.uk\/staging\/company-and-director-fined-following-dangerous-construction-work-around-a-domestic-boiler\/","title":{"rendered":"Company and director fined following dangerous construction work around a domestic boiler"},"content":{"rendered":"<style type=\"text\/css\"><\/style><p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">A building company and its director have been fined for unsafe construction work around a domestic gas boiler which resulted in a gas escape.<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">The magistrates court heard how a building company was contracted to undertake construction work between 26 July and 28 August 2017. The work was an extension to the kitchen.<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">An investigation by the Health and Safety Executive (HSE) found that prior to the work commencing, a pre-existing gas boiler had been located in the kitchen with its flue going out of the rear wall. During the work the original flue outlet was removed, and an external wall was built around it. This had the effect of completely enclosing the flue inside the wall with no direct external exit point for the boiler to safely vent outside.<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">As a result the family of six living in the house were exposed to the risk of inhaling the products of the boiler burning, including Carbon Monoxide (CO), a poisonous gas that has no smell or taste.<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">The Director pleaded guilty to breaching Section 37 of the Health and Safety at Work etc Act 1974. He has been sentenced to a fine of \u00a32,000 and ordered to pay costs of \u00a3431.50.<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">The company pleaded guilty to breaching Gas Safety (Installation and Use) Regulation 8(3). The company has been sentenced to a fine of \u00a316,000 and ordered to pay costs of \u00a3513.10.<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">Speaking after the hearing the principal HSE inspector said:<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">\u201cEvery year, around seven people die from Carbon Monoxide poisoning caused by gas appliances and flues that have not been properly installed, maintained or that are poorly ventilated.<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">\u201cThe Director was negligent in his duties to ensure that during refurbishment of the property that existing gas fittings were not adversely affected.<\/span><\/p>\n<p style=\"background: white; margin: 0cm 0cm 7.5pt 0cm;\"><span style=\"font-family: 'Century Gothic',sans-serif; color: #333333;\">\u201cAll gas work must be done by registered Gas Safe engineers to ensure the highest standards are met to prevent injury and loss of life.\u201d<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A building company and its director have been fined for unsafe construction work around a domestic gas boiler which resulted&#8230;<\/p>\n","protected":false},"author":7,"featured_media":9251,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-9250","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.6 -
